- Distance Selling Act
Winow Wine declares the Distance Selling Act applicable to the General Terms and Conditions. For an overview of this law, see the Distance Selling Act. Winow Wine never delivers to persons under the age of 18! If you order on Winow Wine as a minor, you are in violation and will be reported to the authorities.
- General
2.1 In these general terms and conditions, Winow Wine means: Winow Wine sole proprietorship in Duizel, registered with the Chamber of Commerce Eindhoven: 95303812. Also trading under the personal name Jan Willem Peppink. Buyer: the natural person, partnership, company, legal entity or private individual who has commissioned Winow Wine to perform a service. Services: The service offered by Winow Wine is the sale and delivery of bottles of wine and champagne throughout the European Union and the UK. Also providing tastings, demonstrations, advice and teaching work in the gastronomic field. Further to that Winow Wines offers a service to wine owners to sell their private wines on the Winow Wine webshop.
2.2 Winow Wine reserves the right to change and/or supplement the General Terms and Conditions.
- Offer and Agreement
3.1 Offers or quotations must be regarded as an invitation to the potential Buyers to make an offer. Winow Wine is in no way bound by this, unless this has been recorded in writing and unambiguously. The acceptance of the invitation to make an offer by the potential Buyer is considered an offer and only leads to the conclusion of an agreement if the other provisions of this article have been met.
3.2 An offer from the potential Buyer as referred to in Article 3.1 is deemed to have been made in one of the following circumstances: The potential Buyer has entered the data on the appropriate input screen of the internet site and sent the relevant data to Winow Wine by electronic means.
These were received by Winow Wine.
- The potential Buyer has explicitly indicated by telephone that he wishes to receive a certain product and/or service.
- An offer has been approved in writing by the Buyer and received by Winow Wine in the event that Winow Wine has issued a personal offer.
- Through e-mail traffic, agreement has been reached about the advice, the price, the delivery and details about the offer.
3.3 An agreement is concluded at the moment that an order confirmation has been handed over to the Buyer or, in the event that the offer has been made via the website, has been sent by e-mail to the e-mail address provided by the Buyer. This agreement can be revoked by Winow Wine in the event that the Buyer does not meet the conditions or has done so in the past.
3.4 Information, images, verbal communications, statements, etc. regarding all offers and the main characteristics of the products provided by telephone or e-mail are given or made as accurately as possible. However, Winow Wine does not guarantee that all offers and products are in full compliance with the information provided. In principle, deviations cannot be a reason for compensation and/or dissolution.
- Prices
4.1 All prices are expressed in Euros, in accordance with the legal regulations in this regard, and include VAT for regular wines.
4.2 Winow Wine also sells wines from private collections. Those wines are offered without VAT, so the price does not include VAT, no VAT is charged on the wine. If there are shipping costs, the price for shipping cost include VAT.
4.3 The Buyer shall owe the price communicated to him by Winow Wine in its confirmation in accordance with Article 3.3 of these Terms and Conditions. Obvious (manipulation) errors in the quotation, such as obvious inaccuracies, can also be corrected by Winow Wine after the conclusion of the agreement.
4.4 Special offers are only valid while stocks last.
- Payment
5.1 For orders via the internet site, the private Buyer can pay by prepayment via iDeal or by bank transfer prior to delivery.
5.2 Orders made by the Buyer as a business can be paid for by means of a pre-sent invoice and must be paid for before delivery.
5.3 If a payment method is chosen with a credit card, the terms and conditions of the relevant card issuer apply (including the charge the credit card company makes). Edwines is not a party to the relationship between the Buyer and the card issuer.
5.4 The Buyer shall also be responsible for all (extra-)legal costs of any nature whatsoever that Winow Wine has had to incur as a result of the Buyer’s failure to comply with its (payment) obligations.
5.5 In the event of late payment, Winow Wine is entitled to dissolve the agreement with immediate effect or to suspend (further) delivery until the moment at which the Buyer has fully fulfilled the payment obligations, including the payment of (extra)legal costs of any kind.
- Delivery and delivery time
6.1 Orders will be delivered as soon as possible and taking into account the delivery date specified by the Buyer as much as possible. The final delivery period is 30 days after the delivery date specified by the Buyer. The delivery time mentioned is only an indication, therefore no rights can be derived from it.
6.2 Deliveries will take place at the address specified by the Buyer during the conclusion of the agreement.
6.3 The Buyer is obliged to take delivery of the purchased property within the agreed period. In the absence thereof, Winow is entitled, on the basis of the provisions of Article 6:60 of the Dutch Civil Code, to demand that the competent court release Winow from the obligation to deliver the agreed products, or to demand payment of the purchase price of the part that has not been purchased without prior notice of default. If the Buyer does not meet his payment obligation, Winow Wine is entitled to declare the agreement dissolved without judicial intervention.
- Cooling-off, Withdrawal and Returns
7.1 The consumer Buyer can exercise his right of withdrawal within fourteen (14) working days after delivery of the product without penalty and without giving reasons.
7.2 In the event of dissolution, the consumer Buyer is obliged to return the received product to Winow Wine within 14 working days after the dissolution in the condition in which the consumer received the product. The costs for returning the product are for the account of the consumer Buyer.
7.3 If the consumer Buyer has made use of the right of withdrawal as stated in the previous paragraph, Winow Wine will then refund the order amount due within 14 days after registration of your return, provided that the product has already been returned in good order. Should the product be damaged or the packaging is more damaged than is necessary to transport the product, we can pass on this depreciation of the product to you. So treat the product with care and make sure it is well packaged when returned.
- Force majeure
8.1 In the event of force majeure, Winow Wine is not obliged to fulfil its obligations towards the Buyer. Winow Wine is entitled to suspend its obligations for the duration of the force majeure.
8.2 Force majeure is understood to mean any circumstance beyond its control that prevents the fulfilment of its obligations towards the Buyer in whole or in part. These circumstances include, but are not limited to, strikes, fire, operational disruptions, energy failures, failures in a (telecommunication) network or connection or communication systems used and/or the unavailability of the website at any time, non-delivery or late delivery of suppliers or other third parties engaged and the absence of any permit to be obtained from the government.
- Personal data
9.1 Winow Wine will only process the Buyer’s data in accordance with its privacy policy as described in article 10.
9.2 Winow Wine observes the applicable laws and regulations.
- Privacy
10.1 Winow Wine respects your privacy. You can surf the website without any obligation, without having to enter any personal data. We only ask you to enter your personal details when you actually order. All data provided by you for deliveries is handled with the utmost care and stored securely. This applies to both your own data and the (address) details of the recipient(s) of your order. See also our privacy statement.
10.2 Winow Wine will never rent, distribute or sell personal data, such as name, address and place of residence to third parties. Only at your own request will you be included in our e-mailing, which will inform you at regular intervals of news, individual products or offers. If you do not use our e-mail service, we will only use your data (e-mail and telephone number) to contact you with questions about deliveries. Your own data can be changed or deleted at any time at your request!
